GENERAL TERMS AND CONDITIONS OF BUSINESS FOR ONLINE SALES

Agr. Coop.”);

1. GENERAL.

The services of Cantina Colterenzio Soc. Agr. Coop. for the online store at www.colterenzio.it are provided exclusively based on these General Terms and Conditions in the version valid at the time of the order.

These General Terms and Conditions apply exclusively between Cantina Colterenzio Soc. Agr. Coop. and any person or customer who makes online purchases via the before mentioned website.

The General Terms and Conditions govern the online sale between the seller and the customer, in particular the conclusion of the sale and the delivery of the products offered on the website.

The buyer undertakes to accept without reservation the terms and conditions of business and payment described below and to comply with them in his business relations with the seller.

2. CONCLUSION OF CONTRACT.

Subject matter of the contract.

The object of the purchase contract concluded between the seller and the customer is the product offered on the seller’s website in the online catalog and selected by the customer.

The essential product characteristics are described on the Seller’s website as accurately as possible. Nevertheless, there may be minor differences between the product shown on the website and the actual product. It should also be noted that the photos of the products on the website are merely representative.

The product mentioned is sold by Cantina Colterenzio Soc. Agr. Coop. or purchased by the customer, whereby the contract is concluded exclusively via the Internet by accessing the aforementioned website and carrying out the ordering procedure specified there.

Before confirming the order, the customer undertakes to read and accept these General Terms and Conditions.

2.2 Pre-contractual information.

Before concluding the contract, the Customer shall examine the characteristics and features of the product offered at the time of his selection.

If applicable, the Customer will be informed, in accordance with Legislative Decree no. 206/2005, before confirming the order with payment obligation,

– the total price, including taxes, shipping and delivery charges and any other costs;

– the terms of payment;

– the delivery period;

– the conditions, deadlines and procedure regarding any right of withdrawal;

– the fact that he must bear the costs of returning the product in the event of withdrawal;

– about the legal guarantees for the purchased product;

is informed.

2.3 Conclusion of contract.

The product selected by the customer in the seller’s online catalog is moved to the shopping cart on the website. Once the customer has accepted the shopping cart, he undertakes to fill in the corresponding order form completely and correctly. The contract is concluded as soon as the customer has accepted the purchase with payment obligation and receives a corresponding confirmation from the seller by e-mail to the e-mail address provided by the customer. The confirmation contains the order number, the price of the purchased product, the shipping and delivery charges, the delivery address and the link to print and save a copy of these General Terms and Conditions.

The customer undertakes to check the accuracy of the personal data provided in the above e-mail and to notify the seller of any changes and/or additions without delay.

2.4 Minors.

The customer must have reached the age of 18 to be able to order products from Cantina Colterenzio Soc. Agr. Coop. to be able to order products. The winery does not conclude contracts with minors. The customer must truthfully state his age during the ordering process.

3. PRICES.

All product, shipping and delivery prices stated on the website and in the order confirmation include VAT at the statutory rate, if applicable. The prices are expressed in euros.

The product, shipping and delivery prices are calculated and indicated as part of the online order before payment.

The customer accepts that the seller may change the prices at any time. In any case, the prices indicated on the website and in the confirmation message at the time the order is sent electronically shall apply.

All products are shipped directly from Italy, with the shipping and delivery costs being borne by the buyer in addition to the product price. Unless otherwise specified, in the case of shipments to EU countries where the applicable regulations provide for import duties, the product and delivery prices indicated on the website and in the order are exclusive of any customs duties and related taxes. These are indicated separately before check-out in the shopping cart after entering the delivery address.

These costs shall be borne solely by the customer and shall be paid by the customer at the time of delivery.

4. PAYMENT MODALITIES.

Payment of product, shipping and delivery prices shall be made in advance using one of the methods indicated in the order model on the website.

4.1 PayPal, credit cards and prepaid credit cards.

For online orders via our website, payments by credit card or prepaid credit card are accepted at no additional cost to the seller.

SHIPMENT AND DELIVERY OF THE PRODUCT.

Unless otherwise agreed in writing, the Product ordered by the Buyer will be shipped or delivered exclusively to the countries listed on the Website.

Furthermore, shipment or delivery shall be made by a carrier or courier service selected by the Seller to the address specified by the Buyer in its order. The delivery period is specified in the order confirmation. If the buyer is absent at the time of delivery, he will receive a note with details on how to contact the forwarding agent/courier service to agree the terms of delivery. In any case, the seller is not liable for late or missing delivery of the goods in the event of inaccurate or incorrect address data provided by the buyer.

Each delivery contains the ordered product, the relevant transport document, any documentation required by the State for delivery and any information or marketing documents.

Upon receipt of the goods, the buyer must ensure that the delivered product corresponds to the order; only after this check may he sign the delivery documents.

The buyer is obliged to ensure that only he himself or persons of legal age authorized by him to accept the delivery take delivery of the goods.

If the buyer is in default of acceptance or culpably violates other obligations to cooperate, Cantina Colterenzio Soc. Agr. Coop. shall be entitled to demand compensation for the resulting damage, including any additional expenses. Further claims remain reserved.

The risk of accidental loss or accidental deterioration of the purchased goods shall pass to the buyer at the point in time at which the buyer is in default of acceptance.

5. LIABILITY.

The Seller accepts no liability whatsoever if the goods are delivered late or not at all and this is due to cases of force majeure, such as accidents, explosions, fire, strikes and/or lockouts, earthquakes, floods or other comparable events that prevent the timely execution of the contract in whole or in part.

The Buyer may not hold the Seller liable for operational disruptions or interruptions in connection with the use of the Internet that are beyond the Seller’s control, except in cases of willful misconduct or gross negligence on the part of the Seller.

The Seller shall not be liable to the Customer or third parties for any damages, losses or costs resulting from the non-performance of the contract for the above reasons.

The Seller shall also not be liable for any fraudulent and unlawful use of means of payment by third parties when paying for the products ordered, provided that the Seller can prove that it has taken all necessary precautions in accordance with the current state of knowledge and experience and with the necessary care.

In the event of conformity defects, the provisions of the legal warranty obligation pursuant to Legislative Decree no. 206/2005 shall apply.

COMMUNICATION WITH THE CUSTOMER.

The customer acknowledges and accepts that all communications from the seller in connection with the purchase of the products will be sent to the e-mail address provided by the customer upon registration.

6. OBLIGATIONS OF THE BUYER

The Buyer undertakes to pay the purchase price for the ordered goods within the period and in the form specified in the contract.

The Buyer is strictly prohibited from entering false and/or invented and/or fictitious data when registering via the relevant online form. In the case of personal details and e-mail address, only the Buyer’s own real data and not those of third parties or fictitious persons may be entered. The buyer therefore assumes full liability for the accuracy and truthfulness of the information provided during the ordering process.

The Buyer indemnifies the Seller against any liability for the issue of incorrect tax documents due to incorrect information provided by the Buyer, who is solely responsible for entering the correct data.

When purchasing alcoholic products, the buyer confirms and expressly declares that he/she has reached the legal minimum age of 18 years for the purchase of alcoholic products. In addition, the buyer of alcoholic products declares that the data provided for the execution of the contract is true.

7. APPLICABLE LAW. JURISDICTION.

The contractual relationship shall be governed by Italian law. Subject to the provisions on consumer protection, the subject-matter and local jurisdiction of the judicial authority at the seller’s registered office shall apply.

8. DELIVERY CONDITIONS AND COSTS:

Shipments are made throughout the EU except for Norway. The shipping costs are calculated according to weight and delivery address and are displayed directly in the shopping cart after specifying the desired delivery address. Orders are processed from Tuesday from 09.00 to Friday at 12.00. Free delivery for orders over 300.00 euros.
